1. Scope and who we are
Mallorca Yachts Hire operates hotelviaverdedelasierra.es, offering crewed day charters and longer charters on 32 yachts ranging from sport-yachts and day-boats to yachts and superyachts, with day rates from €1,720. These terms apply to every enquiry and booking made through the website, by email, by telephone or on WhatsApp. Where a written quote or confirmation for your charter states something different from these terms, the written quote or confirmation applies to your booking.
2. From enquiry to confirmed booking
You may send an enquiry form on the website, write to us by email, call us, or message us on WhatsApp. The enquiry form asks for your name, email, phone number if you wish to give it, the yacht you are interested in if you already have one in mind, your preferred charter start and end dates, the number of guests, and any message you want to add.
Once we receive your enquiry, we reply with a written quote that states the chosen yacht, the charter dates, the price and the inclusions. No charter is confirmed at enquiry stage: a booking only becomes binding once we have confirmed it in writing and received the deposit described below. Until that point, either party may withdraw from the discussion without obligation.
3. Prices and what is included
Prices shown on the website are indicative day rates starting from €1,720; the price that applies to your charter is the one stated in your written quote, which reflects the yacht, dates, duration and number of guests you request.
The quote sets out what is included in the price, such as the crew and the vessel for the agreed hours. Fuel, marina fees, an advance provisioning allowance (APA) on larger yachts, catering and any other extras are only charged if they are listed in the written quote; we do not add costs that were not quoted to you.
4. Payment and deposit
A booking is confirmed once we have received a deposit of 50% of the charter price. The remaining balance is due 7 days before departure. If the balance is not received by that date, we may treat the booking as cancelled by the client, in which case the cancellation terms below apply.
5. Cancellation and changes by the client
Because a charter is leisure accommodation booked for a specific date, the 14-day right of withdrawal that normally applies to distance contracts does not apply here, under Article 16(l) of Directive 2011/83/EU and Article 103(l) of the Spanish Royal Legislative Decree 1/2007. In its place, we offer the following voluntary cancellation policy, which is more flexible than the law requires:
- More than 14 days before departure: full refund.
- 7 to 14 days before departure: 50% refund.
- Less than 7 days before departure: no refund.
A change of date is free of charge once, provided you ask for it more than 7 days before departure and the new date is available on the chosen yacht. Any further change is treated as a cancellation and a new booking, under the tiers above.
6. Cancellation by us
If the captain or the relevant port authority considers that weather, sea state or any safety or technical issue makes the charter unsafe, you may choose between a free new date or a full refund. The captain's decision on safety is final and is not open to negotiation on board.
Where a charter cannot go ahead because of force majeure, meaning an event beyond our reasonable control such as an official port closure or a government restriction, the same choice between a free new date or a full refund applies.
7. Guests, capacity and the captain's authority
The number of guests on board may never exceed the licensed capacity of the vessel stated for your charter. The crew may refuse boarding to anyone whose condition or behaviour could endanger the safety of guests, crew or the yacht itself.
Once on board, the captain has full authority over the vessel, the route and the conduct of the charter, including the right to alter or shorten the itinerary, change moorings, or end the charter early where this is necessary for safety. All guests must follow the crew's safety instructions at all times, including the use of life jackets and other safety equipment when requested.
8. Itinerary, conduct on board, damage and belongings
The itinerary discussed with you is a plan, not a guarantee; it may be adjusted by the captain to reflect weather, sea conditions, port requirements or the wellbeing of those on board. We will always try to keep as close as possible to what you booked.
Guests are expected to behave reasonably towards the crew, other guests and the vessel, and to respect any house rules given by the crew at the start of the charter. The client is responsible for damage to the yacht, its tender, equipment or furnishings caused by the deliberate or negligent act of a guest, beyond ordinary wear from normal use.
Personal belongings brought on board remain the guest's own responsibility at all times. We recommend that guests do not leave valuables unattended and arrange their own travel or belongings insurance if they wish to cover loss, theft or damage to personal items.
9. Liability and complaints
We organise the charter with the standard of care expected of a professional charter operator, using crews who are responsible for the safe operation of the vessel. Our liability for loss or damage is limited to what is caused by our own fault or that of our crew, and does not extend to loss caused by circumstances beyond our control, by the guest's own actions, or by matters that fall under the operator's own travel or liability insurance rather than ours. Nothing in these terms limits liability that cannot lawfully be limited.
If anything about your charter falls short of what was agreed, please tell the crew at the time if possible, and write to us afterwards at [email protected] with the booking details and what happened, so that we can look into it properly and respond.
10. Website use, governing law and changes to these terms
The content of hotelviaverdedelasierra.es, including yacht descriptions, photographs and pricing information, is provided to help you plan a charter and may be updated at any time without prior notice. You may not copy or reuse the content for commercial purposes without our agreement. The enquiry form is intended for genuine charter enquiries; we may disregard submissions that are abusive, fraudulent or unrelated to chartering a yacht.
These terms, and any booking made under them, are governed by Spanish law. Any dispute that cannot be resolved directly between the parties will be submitted to the courts of Mallorca, Balearic Islands, without prejudice to any mandatory right a consumer may have to bring proceedings before the courts of their own place of residence.
We may update these terms from time to time to reflect changes to our service; the version published on the website at the time of your enquiry applies to your booking, and any later change does not affect a charter already confirmed in writing.
